Refund Policy

This Refund Policy applies to the Morning Market Brief email newsletter and to any digital products and other products or services offered by Shears Capital ("Shears Capital," "we," "us," or "our") through the websites located at shearscapital.ca and shearscapital.com (the "Site"). This Refund Policy is incorporated into and forms part of our Terms of Service.

1. What This Policy Covers

We offer:

  • The Morning Market Brief — a research and education email newsletter provided free of charge; and
  • Digital Products — one-time purchases of downloadable digital goods, including individual AI prompt files and prompt bundles ("Digital Products"), sold at the prices shown at checkout.

Because the Morning Market Brief is free, there are no charges and therefore nothing to refund in connection with it. The refund provisions below apply to paid Digital Products.

2. Digital Products Are Non-Refundable Once Delivered

Digital Products are delivered electronically and are made available for download and/or sent by email immediately after your payment is confirmed. Because they are intangible goods that cannot be returned once delivered, all sales of Digital Products are final, and we do not offer refunds, prorated refunds, or partial credits, including for:

  • a Digital Product you purchased but did not download, open, or use;
  • a change in your personal circumstances, financial situation, or investment objectives after purchase;
  • a purchase you made in error after the Digital Product has already been delivered; or
  • losses, gains, or other outcomes resulting from any trading or investment decisions you made based on or related to a Digital Product or the Morning Market Brief.

By completing a purchase, you acknowledge and agree that delivery of the Digital Product begins immediately, and you consent to that immediate delivery.

3. Cancellation

The Morning Market Brief is free; you may unsubscribe at any time using the link in any email or by contacting us at admin@shearscapital.com.

Digital Products are one-time purchases. There is no subscription, recurring charge, or auto-renewal associated with them, so there is nothing to cancel after purchase.

4. Limited Exceptions

Notwithstanding Section 2, we may, at our sole discretion, issue a refund or credit in the following limited circumstances:

4.1 Duplicate Charges

If you were charged more than once for the same Digital Product due to a technical or processing error, we will refund the duplicate charge. Contact us within ninety (90) days of the duplicate charge.

4.2 Unauthorized Charges

If you believe a charge was made without your authorization (for example, if your payment method was compromised), contact us immediately. We will investigate and, where appropriate, work with our payment processor to resolve the matter.

4.3 Non-Delivery or Defective Files

If you did not receive your Digital Product, or the files you received are corrupted or unusable, and we are unable to resolve the problem by re-sending or otherwise making the Digital Product available to you within a reasonable time, you may request a full refund of that purchase. Submit your request to admin@shearscapital.com within thirty (30) days of the charge.

5. How to Request a Refund

To request a refund under any of the exceptions in Section 4, contact us at admin@shearscapital.com with the following information:

  • the email address associated with your purchase;
  • the date and approximate time of the relevant charge;
  • the Digital Product(s) involved;
  • a brief description of the basis for the refund request; and
  • any supporting documentation (for example, screenshots of duplicate charges or a description of the delivery problem).

We will review your request and respond within ten (10) business days. If approved, refunds are issued to the original payment method via Stripe and typically appear within five (5) to ten (10) business days, depending on your card issuer or bank.

6. Chargebacks

Before initiating a chargeback or payment dispute with your bank or card issuer, we ask that you first contact us to attempt to resolve the matter directly. Chargebacks initiated without first contacting us may result in suspension of access to our products and, where applicable, recovery of associated fees.

7. Modifications

We may update this Refund Policy from time to time. The version dated above is the operative version for charges made on or after that date. Charges made before a policy change are governed by the version of this policy in effect on the date of the charge.
